Terms of Service
Effective date: November 24, 2026
These Terms of Service (the "Terms") set out the conditions for using "YSM (Your Smiling Memories)" (the "Service"), provided by Toa Kagawa, trading as YSM (the "Operator").
Article 1 (Application of These Terms)
- These Terms apply to everyone who uses the Service.
- Any individual conditions that the Operator sets out on screens of the Service or in its Help pages (including conditions shown on order screens; "Individual Provisions") form part of these Terms. If these Terms and any Individual Provisions conflict, the Individual Provisions prevail.
- Travel services that the Operator begins offering after being registered as a travel agency are governed by separately established travel agency terms and conditions of trade, not by these Terms (Article 17).
Article 2 (Agreement to These Terms)
- Anyone who registers an account with the Service (a "User") uses the Service after agreeing to these Terms on the account registration screen. These Terms also apply when you order a Book or Calendar (each as defined in Article 11), purchase the City Map (as defined in Article 9), or subscribe to a paid membership plan (Plus or Pro; a "Paid Plan").
- Between a User who has agreed to these Terms and the Operator, these Terms form the content of the contract.
- These Terms can be viewed at any time within the Service and on our website.
- Anyone who views an itinerary through an Invite Link (as defined in Article 5) without registering an account must also comply with Article 15 (Prohibited Conduct) to the extent of that viewing.
Article 3 (Accounts)
- You can register an account with an email address, Apple, or Google.
- Each person may hold only one account. You may not share an account with, or transfer or lend it to, any third party.
- You must keep the information you register accurate and up to date.
- You are responsible for managing your login credentials. The Operator is not liable for any damage arising from inadequate management of credentials or from their use by a third party, except where the Operator is at fault, whether intentionally or negligently.
- If you register with Apple or Google, their respective terms of use also apply.
- The Operator will contact you through in-app notifications or by email to your registered email address.
Article 4 (Use by Minors)
- If you are a minor, please use the Service (including paid orders and Paid Plans) only with the consent of a parent or other legal guardian.
- If a minor places a paid order or subscribes without the consent of a legal guardian, the order or subscription may be rescinded in accordance with law. However, it cannot be rescinded where, for example, the order falls within the scope of property the legal guardian has permitted the minor to dispose of, or where the minor used fraudulent means to make the Operator believe that they were an adult or had a legal guardian's consent (Civil Code of Japan, Articles 5 and 21).
Article 5 (Sharing a Trip)
- A User who creates a unit for one journey in the Service (including its itinerary, shared album, bill splitting and other content; a "Trip") can invite others to the Trip by sending them a link for joining the Trip (an "Invite Link"). The User who created the Trip and Users who joined it through an Invite Link are referred to as "Trip Members".
- Anyone who knows an Invite Link can view the itinerary without registering an account. An account is required to add photos or videos. Please send Invite Links only to people you trust.
- Trip Members can edit the itinerary together and add photos and videos to the shared album. All Trip Members of that Trip can view the photos and videos in the shared album.
- The Operator will not make any information that Users enter into or upload to the Service, including photos, videos, itineraries, diaries, notes and booking records ("User Content"), available beyond the scope set out in this Article.
Article 6 (Rights in User Content)
- Copyright and all other rights in User Content remain with the User who added it (or the original rights holder) and are not transferred to the Operator.
- You grant the Operator, free of charge and to the extent necessary to provide the Service, permission to store, copy, process, display, transmit and print your User Content.
- The Operator will not use User Content beyond the scope of the preceding paragraph (unless you separately agree). The Operator will not use User Content for advertising or for training AI.
- For Users who have consented to statistical use, the Operator may process the content of their Trips into statistical data from which no individual can be identified, and use it to improve the Service, make travel suggestions, analyse travel and tourism trends, and for similar purposes. Details are set out in the Privacy Policy.
- A User who adds photos or videos to a shared album permits the Trip Members of that Trip to view those photos and videos within the Service and to use them in Trip Books, Books and Calendars (each as defined in Article 11).
- You warrant that you hold the rights necessary for your User Content, or have obtained permission from the rights holders.
Article 7 (Respect for People in Photos)
- When you post photos or videos showing people, you must obtain the consent of the people shown. If a person shown is a child, you must obtain the consent of the child's legal guardian.
- Please agree among the Trip Members how photos and videos in a shared album are to be handled. The Operator will respond to legal requests from anyone who believes their portrait rights or other rights have been infringed in accordance with Article 16.
Article 8 (Storage of Photos and Videos)
- For Users on the free plan, photos and videos are stored as follows:
- 14 days after upload, original-quality data is replaced with viewing-quality data (the photos themselves are not deleted).
- Photos used in a Trip Book, Book, Favourites or Extras are also stored in print quality.
- Videos may be up to 60 seconds each, in 720p.
- For Users on a Paid Plan, original-quality photos are stored for as long as the plan continues. Videos may be up to 5 minutes each in 720p on Plus, and up to 10 minutes each in 1080p on Pro. When a plan ends, the original-quality data is replaced with viewing-quality data after 14 days, as in the preceding paragraph. For the original-quality photos of Pro Invited Members (as defined in Article 14, paragraph 9), paragraph 11 of that Article applies.
- Videos are not deleted on any plan, including after a Paid Plan ends.
- To keep the Service running stably, the Operator may restrict uploads that exceed an amount per period set by the Operator. Even in that case, photos and videos already stored will not be deleted.
- If you need photos and videos exactly as they were taken, please also keep them on your own device or elsewhere.
- Photos and videos that you delete cannot be restored, even by the Operator.
- The Operator takes appropriate measures to prevent the loss of User Content. If User Content is lost for reasons attributable to the Operator, the Operator will compensate you in accordance with Article 19.
Article 9 (Bill Splitting, Maps and Other Features)
- Bill splitting is a feature that records and calculates who paid how much towards the costs of a Trip. The Operator does not receive or transfer money between Users. Please settle up among yourselves.
- Place information shown on maps and itineraries may contain errors or be out of date. Please also check official sources for opening hours, transport and similar information.
- Country maps and state/prefecture maps are free to use. The map that records places visited by city, town and municipality (the "City Map") is a paid feature that can be purchased only as a one-time in-app purchase on the App Store or Google Play. The price in Japan is JPY 480 (tax included). (Outside Japan, the price in the local currency of each country or region is shown on the store's purchase screen before purchase.) One purchase per account is sufficient, and the City Map can be used on the account that purchased it for as long as the Service is provided. The City Map is also included in the Paid Plans (Plus and Pro), excluding Invited Members as defined in Article 14, paragraph 9. Users who access the City Map through a Paid Plan will no longer be able to use it after the plan ends.
- Because the City Map is digital content that can be used immediately after purchase, purchases cannot be cancelled or refunded for your own reasons. Refund requests follow the procedures set by Apple or Google. Only if you are unable to use it for reasons attributable to the Operator will the Operator arrange a refund, working with Apple or Google as far as possible.
Article 10 (Booking Records)
- Booking records is a feature for attaching details of bookings with accommodation, transport and other providers to an itinerary. Booking details are entered manually, and screenshots and PDFs can be attached as images.
- Room access codes (passcodes) can be viewed only by the Trip Members of that Trip and are deleted after check-out.
- Changes, cancellations and payments for bookings are governed by the contract between you and the provider. The Operator does not arrange bookings.
Article 11 (Trip Books and Orders for Books and Calendars)
- After a Trip ends, the Operator automatically creates a draft book (this draft and its digital version are referred to as a "Trip Book"). The digital version of a Trip Book is free to use.
- Printed versions of Trip Books ("Books") come in three types: one Trip, several months, or one year. A one-year Book is produced as two volumes. Books are hardcover and landscape. The number of pages varies between 24 and 296 depending on the number of photos, and prices are set for each page range (up to 24, 25-50, 51-100, 101-200 and 201-296 pages; prices include tax and shipping and are shown in the currency of the delivery country or region). Prices are shown before you order.
- Printed calendars made with photos from your Trips ("Calendars") come in two types: the Wall Calendar (A4 landscape, 13 sheets) and the Postcard Calendar (postcard size, 13 sheets, with a case). Prices include tax and shipping and are shown on the order screen before you order, in the currency of the delivery country or region. The countries and regions where Calendars are sold are also shown on the order screen. This Article and Article 12 apply to Calendar orders in the same way as to Book orders.
- Each Book is produced to order by an external printing company. The countries and regions to which we can deliver are shown on the order screen.
- A sales contract is formed when you confirm your order on the order screen, payment is completed, and the Operator sends an acceptance email.
- Payment is made by credit card at the time of order (prepayment). Payments are processed by Stripe.
- Orders are shipped within 7 days of the date payment is completed. Delivery usually takes 6-9 days from the order date within Japan and 8-14 days from the order date outside Japan. If you would like delivery before the end of the year, please order by the cut-off date for your country or region (December 14 for Japan; for other countries and regions, shown on the order screen). We will make every effort to deliver before the end of the year but cannot guarantee it.
- Orders can be sent as gifts to an address different from yours. The packing slip enclosed does not show prices.
- Please check the content of your Book (photos, text and order) before ordering. It will be printed exactly as you confirmed it. Colours on screen may differ slightly from print. Photos of low original quality may print coarsely.
- The Operator cannot produce Books with content that violates laws or these Terms. In that case, the Operator will not accept the order and will refund the full price.
Article 12 (Cancellations, Returns and Defective Items)
- Books and Calendars (in this Article, "Products") are made to order and go into production preparation as soon as an order is confirmed. Therefore, once an order is confirmed, we cannot accept cancellations, returns or exchanges for your own reasons.
- If a Product you receive has any of the following defects, please contact us through the in-app contact form or at support@ysm-travel.com within 8 days of delivery, with photos showing its condition. The Operator will send you a reprinted Product or refund the price.
- Printing defects (smudges, faded print, etc.)
- Missing pages or pages in the wrong order
- Damage in transit
- Receipt of a Product different from what you ordered
- For defects that are difficult to find on delivery (such as binding coming apart), please contact us as soon as possible after you find them. They will be handled in the same way as under the preceding paragraph.
- When a refund is made, any amount paid with a Gift Card or Book Voucher will be returned to the Gift Card balance or as Book Vouchers.
- If a Product needs to be returned, the Operator will bear the shipping cost.
- This Article does not limit any rights you have under law, such as the right to terminate the contract or to claim damages for reasons attributable to the Operator.
Article 13 (Discounts, Referral Coupons, Book Vouchers and Gift Cards)
- If you order two or more copies of the same Book in one order, or order a one-year Book split into two volumes, each copy from the second onward is discounted by 10% (for a two-volume Book, the second volume is discounted by 10%).
- Referral discounts are subject to the following conditions:
- When someone you referred orders a Book for the first time, a 15% discount coupon (for one Book) is issued to each of you.
- One coupon is issued per referral.
- Coupons can be used only towards the price of Books. They cannot be used for Calendars or Paid Plans.
- People who registered through a Trip Invite Link are not eligible for referrals.
- You may not refer yourself or use fictitious or multiple accounts.
- Coupons are valid for 1 year from the date of issue. They cannot be exchanged for cash or transferred to a third party.
- If fraudulent use is discovered, coupons may be cancelled.
- Users on the Pro plan can purchase Books at a 10% discount.
- Book Vouchers are subject to the following conditions:
- Book Vouchers come in packs of 3 and packs of 6. One voucher can be used per Book ordered.
- One voucher pays for one Book in the smallest page range (up to 24 pages). For Books with more pages, you pay the difference.
- Book Vouchers are used at the price and currency of the delivery country at the time of purchase.
- Book Vouchers are valid for 2 years from the date of purchase. Expired vouchers cannot be used.
- Book Vouchers cannot be combined with other discounts or coupons.
- After purchase, Book Vouchers cannot be refunded, exchanged for cash or transferred to a third party (except where a refund is required by law).
- Gift Cards are subject to the following conditions:
- A Gift Card is sent by email to the recipient, for an amount chosen by the purchaser.
- By adding a Gift Card to their account, the recipient can use it to pay for Books and Calendars. The amount is automatically deducted from the price, and any unused balance can be used for later orders.
- Gift Card amounts are shown in the currency of the purchaser's country or region. If the recipient's currency is different, the amount is converted into the recipient's currency at the exchange rate on the date it is added and credited to the balance. For orders delivered to a country with yet another currency, the amount is converted at the exchange rate on the order date and deducted.
- Gift Cards are valid for 3 years from the date of receipt.
- Gift Cards cannot be used to pay for Paid Plans (Plus and Pro). They cannot be exchanged for cash or refunded (except where a refund is required by law).
- A Calendar purchased together with a Book is discounted by 10% (this discount is not available in some countries and regions; this is shown on the order screen).
- Discounts cannot be combined. For each Book, only the single largest applicable discount is applied.
Article 14 (Paid Plans)
- The Operator will offer Paid Plans (Plus and Pro). You can subscribe either through in-app purchase on the App Store or Google Play ("In-App Purchase") or on the YSM website, where payments are processed by Stripe (the "Website"). Prices differ by channel and by country or region, and Website prices are set lower than In-App Purchase prices. In Japan, In-App Purchase prices are JPY 600 per month or JPY 5,800 per year for Plus, and JPY 1,200 per month or JPY 11,800 per year for Pro; Website prices are JPY 530 per month or JPY 5,100 per year for Plus, and JPY 1,050 per month or JPY 10,400 per year for Pro (all tax included). Prices outside Japan are shown in the local currency on the store's purchase screen or on the Website's pricing page. Each price is shown before you subscribe. The contents of each plan are shown on the pricing page.
- If you subscribe to Pro for the first time, you can use it free of charge for the first month, whichever channel and whether monthly or annual billing you choose. The free month is available only once per account.
- For subscriptions made through In-App Purchase, billing, automatic renewal, cancellation and refunds are governed by this Article and also by the terms and procedures of Apple or Google.
- On the last day of the free period, you pay the fee for the first billing period using your registered payment method. The plan then renews automatically until you cancel (monthly plans every month, annual plans every year), and you pay the fee for the next period on each renewal date. If you have used a free period before, you pay the fee for the first period on the date you subscribe.
- You can cancel at any time: for Website subscriptions, from the Settings screen or the Website; for In-App Purchase, from your App Store or Google Play account settings. If you cancel during the free period, you will not be charged (and you can use the plan until the free period ends). If you cancel, your plan ends when the period you have paid for expires, and you can use it until then. If you cancel before the next renewal date, you will not be charged for the next period. There is no cancellation fee.
- If you cancel partway through a period, the fee for the remainder of the period will not be refunded on a pro rata basis. However, if the Operator was unable to provide the features of a Paid Plan for reasons attributable to the Operator, the fee for that period will be refunded (for In-App Purchase, the Operator will handle this working with Apple or Google as far as possible).
- Any change to fees will be announced within the Service and on our website. A price increase applies from the first renewal after the date of the announcement (if you cancel before then, the new fee will not be charged).
- If payment at renewal cannot be completed, the Paid Plan may be ended.
- A User subscribed to Pro (in this Article, the "Subscriber") can invite other Users, up to the number of people shown on the pricing page, and share with them the feature for storing and downloading photos in original quality (Users so invited are referred to as "Invited Members"). The features available to Invited Members are shown on the pricing page.
- The Subscriber can change Invited Members (that is, remove an Invited Member or invite a new one) no more than once every 30 days.
- If an Invited Member is removed, or if the Subscriber's Pro plan ends, the original-quality data of that Invited Member's photos will be replaced with viewing-quality data after 14 days (the photos themselves are not deleted). The Operator will also notify Invited Members who are removed. If you need the original-quality data, please save it yourself before it is replaced.
- The storage of photos and videos after a Paid Plan ends is governed by Article 8.
Article 15 (Prohibited Conduct)
When using the Service, you must not engage in any of the following:
- Conduct that violates laws or public order and morals, or conduct connected to criminal activity
- Conduct that infringes the copyright, portrait rights, privacy, reputation or other rights of others
- Disclosing the personal information of others without their consent
- Posting obscene content, content that sexualises children, or content that promotes violence or discrimination
- Harassing others or impersonating others
- Unauthorised access, placing excessive load on the Service's servers or networks, or otherwise interfering with the operation of the Service
- Modifying the Service's software, or analysing it by decompiling, disassembling or similar means
- Creating multiple accounts as one person, or misusing referral discounts
- Using the Service for sales or promotional purposes without the Operator's permission
- Using Trip Members' booking information or access codes for any purpose other than the Trip concerned
- Directly or indirectly providing benefits to Anti-Social Forces (as defined in Article 24)
- Encouraging any of the conduct listed above
Article 16 (Handling of User Content and Suspension of Use)
- Photos and videos in a shared album are managed among the Trip Members of that Trip. Trip Members can also delete photos and videos added by other members. Deleted photos and videos cannot be restored, even by the Operator.
- If the Operator receives a request based on law (such as a request to take measures to prevent transmission from a person claiming their rights have been infringed, or a request for disclosure of sender information), the Operator will respond in accordance with law.
- Requests under the preceding paragraph can be made through the in-app contact form or at support@ysm-travel.com.
- If a User seriously violates Article 15 or violates it repeatedly, the Operator may, after giving prior notice, suspend the User's use of the Service or delete the User's account. Where urgently necessary to prevent harm to other Users or third parties, the Operator will notify the User afterwards.
Article 17 (Travel Agency Services)
- Services that require travel agency registration, such as arranging made-to-order planned tours and travel gifts, will begin only after the Operator is registered as a travel agency.
- These services will be governed by separately established travel agency terms and conditions of trade, not by these Terms.
- The Operator will not arrange travel until it is registered as a travel agency.
Article 18 (Changes, Suspension and Termination of the Service)
- The Operator may change the content of the Service. Changes that would cause Users significant disadvantage will be announced in advance.
- The Operator may temporarily suspend all or part of the Service in the event of system maintenance or inspection, failures of equipment or communication lines, suspension of external services used by the Operator, natural disasters, power outages or other unavoidable circumstances. Planned suspensions will be announced in advance.
- If the Operator ends the Service, it will announce this at least 90 days in advance. Paid Plan fees for any period after the end date will be refunded (for In-App Purchase, working with Apple or Google). Books and Calendars already ordered will be delivered, or their full price refunded.
- If the Operator transfers the business relating to the Service to another party, it may transfer its position under these Terms, and data including User information, to the transferee. In that case, this will be announced in advance.
Article 19 (Compensation for Damage)
- If the Operator causes you damage intentionally or negligently, the Operator will compensate you for that damage.
- Notwithstanding the preceding paragraph, for damage caused by the Operator's ordinary negligence (excluding cases of intent or gross negligence on the part of the Operator), the Operator will compensate only for damage that would ordinarily arise, up to the following amounts:
- Damage relating to an order for a Book or Calendar: the price of that order
- Damage relating to a Paid Plan: the plan fees paid in the 12 months before the damage occurred
- Other damage (including damage relating to free features): JPY 10,000
- The limits in the preceding paragraph do not apply to damage to a person's life or body.
- The Operator will also compensate, in accordance with this Article, for damage caused by reasons attributable to businesses to which the Operator outsources work (printing companies, cloud services, etc.).
- Disputes between Users, or between a User and a third party, are to be resolved between the parties concerned. However, any part for which the Operator is responsible is governed by this Article.
Article 20 (Closing Your Account)
- You can close your account (delete your account) at any time from the Settings screen or through the contact form.
- If you close your account during a Paid Plan period, the plan also ends at that time. Fees for the remaining period will not be refunded. If you subscribed through In-App Purchase, closing your account does not stop automatic renewal, so please cancel in your App Store or Google Play account settings.
- When you close your account, your account and User Content are deleted. However, photos and videos you added to shared albums remain in the albums of the other members. If you do not want them to remain, please delete them before closing your account.
- Books already printed and statistical data from which no individual can be identified cannot be deleted. Order records are kept only for the period required by law.
- Please save any photos and videos you need yourself before closing your account.
- Free-plan accounts with no login for 2 years may be deleted. We will notify you at your registered email address 1 month before deletion, and the account will not be deleted if you log in once before then. Users with an ongoing Paid Plan and Users with an unexpired balance (Gift Card or Book Vouchers) are excluded (they become eligible after the plan ends or the balance expires). Photos and videos added to shared albums remain in the albums of the other members.
Article 21 (Changes to These Terms)
- The Operator may change these Terms in either of the following cases (Civil Code of Japan, Article 548-4):
- Where the change conforms to the general interests of Users
- Where the change does not run counter to the purpose of the contract and is reasonable in light of the necessity of the change, the appropriateness of the changed content and other circumstances
- When changing these Terms, the Operator will announce the change, the changed content and the effective date within the Service and on our website before the effective date. Changes that are disadvantageous to Users will also be notified to their registered email addresses.
- If you do not agree to a change, you may cancel your plan or close your account before the effective date.
Article 22 (Handling of Personal Information)
The Operator handles Users' personal information appropriately in accordance with its separately established Privacy Policy.
Article 23 (Rights in the Service)
Copyright and other intellectual property rights in the Service (including the app, website, design and text, but excluding User Content) belong to the Operator or to third parties with legitimate rights. Permission to use the Service under these Terms does not mean the transfer or licensing of those rights.
Article 24 (Exclusion of Anti-Social Forces)
- You represent and warrant that, now and in the future, you are not an organised crime group, a member of an organised crime group, a person who ceased to be a member of an organised crime group less than 5 years ago, an associate member of an organised crime group, a company affiliated with an organised crime group, a corporate racketeer, a person engaging in criminal activities under the guise of social campaigns, a specialised intellectual crime group or any person equivalent to these ("Anti-Social Forces"), and that you have no relationship with Anti-Social Forces that should be socially condemned.
- If it is found that you have violated the preceding paragraph, the Operator may suspend your use of the Service or delete your account without prior notice.
Article 25 (No Assignment of Rights and Obligations)
You may not assign, have succeeded, pledge as security or otherwise dispose of your position under these Terms or your rights or obligations under these Terms to any third party without the Operator's prior consent.
Article 26 (Severability)
Even if any provision of these Terms, or any part of one, is held invalid or unenforceable under the Consumer Contract Act or any other law, the remaining parts of these Terms continue in full effect.
Article 27 (Governing Law and Jurisdiction)
- These Terms are governed by and construed in accordance with the laws of Japan.
- Any lawsuit relating to the Service shall be brought in a court having jurisdiction under the Code of Civil Procedure of Japan.
Supplementary Provision
These Terms take effect on November 24, 2026.
